The truth bothers people, but not me. Full transparency, at least from my side, has always been my approach.

If you’re going to lie under oath, at least get your story straight.

In the first sworn response by Bob Fitzsimmons CEO and owner of nuEra Cannabis on June 6, 2024, they flatly denied:
• Withholding financials.
• Diverting money.
• Violating fiduciary duties.

Basically: “No, we didn’t do that. No financials are owed. No mismanagement here.”

Now, in their latest response, they pulled a bold move:
• They’re waving around a September 2024 letter from their accountants, Cherry Bekaert, as proof they “complied” and provided financials.

Let me spell that out for you:
1. On June 6, they swore financials were never withheld—no issues here.
2. By September 2024, they finally delivered only 2023 tax filings(not 2020-2022)—a full year after I sued them.
3. And now they’re using those late filings to prove compliance?

That’s not proof. That’s an admission.
An admission that what they swore to in June was false.

Under oath. Sworn statements.
You can’t have it both ways:
• Either the financials were never owed, as they claimed.
• Or they were owed, withheld, and delivered only under pressure of litigation.

So which is it? Because the contradiction smells like perjury.

But wait, there’s more:
They were secretly suing the management company contracted during ongoing litigation to divert 100% of all profits, Paisley Trees, behind closed doors—without disclosing it. Another breach of fiduciary duty they swore they didn’t commit.

And while we’re here… a quick question for their attorneys at Latimer LeVay Fyock LLC:
Is this ethical under ARDC: Attorney Registration and Disciplinary Commission of the Supreme Court of Illinois rules, or are you comfortable signing off on contradictions under oath? Asking for a friend.

They’re playing legal chess, but they just knocked over their own king.

This isn’t just sloppy lawyering. In my opinion, it’s a pattern of concealment, fraud, and outright lies under oath.

So what happens next?
Discovery gets uglier. Depositions get real. And regulators— Security Exchange Commission, Internal Revenue Service, Illinois Department of Revenue, Illinois Department of Financial and Professional Regulation, Illinois Department of Agriculture, Kwame Raoul, JB Pritzker, Michigan Department of Treasury, Michigan Department of Licensing and Regulatory Affairs, Gretchen Whitmer, and Dana Nessel, do you plan to step in, or are we pretending this isn't happening?

At what point do these regulators do their jobs and start sizing these people up for new bracelets? Or are they turning a blind eye because they’re complicit and part of the fraud?

So who watches the watchmen?
